PRESS RELEASE:

I am announcing my candidacy for Judge of the Washington County Court of Common Pleas. I have been a practicing trial attorney in Washington County for thirty-seven (37) years. I have been married to Sherry Maley since 2005 and reside in Canton Township. I graduated from Duquesne Law School and hold both a Master's Degree in Sociology from Duquesne Graduate School and a law degree from the Duquesne Law School.

I have volunteered to help many non-profit clubs and organizations and have served on the Board of Directors for Habitat for Humanity. My wife has served on the Board for the American Cancer Society and works for CAS Head Start.

In my thirty-seven (37) years of practice I have handled thousands of trials before Magistrate District Justices, Arbitration Boards, Independent Masters, Administrative Law Judges, and Jury and Non-Jury Trials including arguments before the Pennsylvania Superior and Supreme Court creating law in the State of Pennsylvania. I have handled civil cases in which my clients over those years have received awards totaling over a million dollars in compensation. I have also been an ongoing member of the Washington County Bar Association pro bono program helping those who are unable to afford an attorney but need their rights protected.

During those thirty-seven (37) years I have been an outspoken champion of the public's right to good law and upholding the Constitution of the United States and its laws. This is something the government and our court's are slowly discarding. We don't need liberal judges and lawlessness in a system designed to uphold the law. I have gone head to head with Judge's and their misapplication of the law and their bad decisions. I have reversed more Judges than any other candidate running for this position. A bad decision by a Judge effects us all and costs both sides thousands of dollars unnecessarily. As the past President of the Washington County Bar Association Family Division I implemented a monthly schooling of members on cases being decided by the Appellate Courts. This diverse background and understanding of the law, better than the Judges I have reversed, indicates my competency and my ability to correctly apply the law.

Judges are sworn to protect, preserve and defend the Constitution and laws of this Commonwealth when they are elected. If you have kept apprised of recent media reports you have seen that some of our Judges have made our county become an embarrassment across the state and country and to the very taxpayers that pay their salary. The President Judge Seneca has been accused by attorneys of changing transcripts in the very hearings held before her once the hearing transcript was transcribed. She is no longer on the bench. One Judge has been earmarked and rebuked by a Superior Court for conduct unbecoming a Judge. Another Judge has been removed from the bench for taking for his personal pleasure drug evidence from the evidence locker. This is what lawyers and the general public must face when they come to the Court House to find justice and fairness in keeping our families safe. It is Judges like this that give a bad name to good judges and our system of justice. It is disheartening. Not since 1960 when Washington County was named as the most corrupt county on the Eastern seabord by Time magazine have such things occurred bringing embarrassment to our county.

My ability to deal in such an arena clearly indicates my tenacity and temperament under adversity. Electing a Judge with long term experience of thirty-seven (37) years and the ability to correct other Judges when they are wrong in their decisions is critical to preserving a skilled, understanding and compassionate judiciary. You receive that kind of knowledge after thirty seven (37) years of practice. Not to mention one who is truly skilled in the law when the Superior Court agrees with him and overrules a sitting Judge. It is critical to elect someone with years of experience instead of someone who is just starting to understand the law. Electing someone with experience in the Washington County Court system is also important. Two candidates have chosen to practice in Allegheny County and do not understand Washington County residents.

We have a judicial crisis. We are in serious need of legal leadership and clarity in our Judiciary and the application of the law to help and not harm families. I have demonstrated my commitment to serve the general public and protect them from harm both outside the Courtroom and inside the Courtroom. We do not need judges who think they are above the law and who are looking to pick a fight and act like a bully on the bench, as the Superior Court recently earmarked one Judge. A person coming into the Courtroom should have a level playing field not one which is on tilt because of a Judge's demeanor or personal and political agenda.

We all have experienced bad scenarios with Judges in the last few years as I have mentioned. Voters and Taxpayers deserve better. I am not a member of the inside Courthouse bureaucracy and electing someone from the inside will just perpetuate the problems that you have already seen and already exists. The present insiders will attempt to elect someone from the inside to perpetuate their system of justice. I firmly believe that someone who is an outsider and not a present employee of the system needs to be elected before things are straightened out. Once elected I would work to implement drug and alcohol testing for all Judicial positions. I will also work hard to bring respect, confidence and fairness back to a system of justice that the people deserve. Please join the campaign!

Ask yourself if you are happy with the last two-three years of what you have read in the newspaper about the Washington County CourtHouse and our judges. We are an embarrassment and a laughing stock across the state and the country. It is almost as comparable to the 1960's Times news article which called Washington County the most corrupt court system on the Eastern seaboard.

I submit to you vote for someone outside of the Court System Bureaucracy and who has not been on the public or county payroll. Not someone who is already a Magistrate or a District Attorney or has ties to the Court House. Vote for someone who represents people in the system and has seen how some Judges treat the unfortunate who come before them. Someone who is not already in the system or a part of the system and will give everyone who comes before them a level playing field and uphold their oath to protect, preserve and defend the Constitution. Someone already in the system will only perpetuate a system that seriously needs to be corrected by people who are informed of what really goes on.

I pledge to you to be a candidate that will protect, preserve and defend the Constitution and laws of this Commonwealth with clarity and transparency. I'm not interested in hiding the "secrets" of the Court House but more so in exposing them. I have both the integrity and knowledge through experience and commonsense and commonsense and honesty through my upbringing. I believe in term limits and drug testing, yes drug testing even for Judges. I humbly request your vote.

REVERSALS OF JUDGE'S WRONG DECISIONS BY A HIGHER COURT

An attorney's decision to appeal the decision of a Judge to a higher court comes with much contemplation and consternation. Legal principles are enunciated in Statutes and cases decided by higher courts. The decision is one not taken lightly but none the less taken when a Judge exhibits no understanding of the law or a misapplication of the law to the facts of the case before him. The appeal is both a tedious and expensive process for both the lower court victor and the lower court loser. A judge in such a bad or wrong decision thereby penalizes both litigants for his misunderstanding of the law. It also indicates to everyone the experience, ability and understanding of an attorney when matched against the ability and understanding of a sitting Judge.

THE COURTHOUSE FEELS THAT THIS POSTER ADVISES YOU THAT YOUR CIVIL LIBERTIES CAN BE SET ASIDE AND ANY AND ALL CONVERSATIONS CAN BE MONITORED. I WILL PLEDGE TO YOU THAT SUCH SURVEILLANCE AND MONITORING WILL NOT OCCUR ONCE I AM ELECTED JUDGE AND THE MICROPHONES WILL BE SHUT OFF AND ONLY USED ONCE A TRIAL BEGINS. AT THIS POINT IN TIME THE MICROPHONES ARE ALWAYS ON.

Also, pay attention to the closing statements wherein all the candidates speak about the cases they have handled, but only Chuck shows specifically who has handled more cases than the others with documentary evidence.

It has been reported that Kristen Clingerman, prosecutor and ADA, is reported to have fallen asleep during a jury trial in the case of Commonwealth vs. Luis Martinez at 768 of 2016. This occurred approximately February 2016 and we are attempting to get the transcripts of the event. The result of the case was that the jury declared a mistrial.
